Shain – Terms of Use

Welcome to Shain (“the App”). These Terms of Use (“Terms”) govern your access to and use of Shain. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please stop using the App.

1. Overview of the Service

Shain is an AI-powered photo generation and editing application. The App processes uploaded photos and prompts using machine-learning models in order to generate stylized images. All outputs are AI-generated and may contain inaccuracies, artifacts, or unexpected results.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use Shain. If you are under 18, you may only use the App with the consent and supervision of a parent or legal guardian.

3. User Content

3.1 Uploading Content

You may upload photos, text prompts, and other materials (“User Content”) to the App. By uploading User Content, you confirm that:

• You own the content or have all necessary rights and permissions to use it.
• Your content does not violate any applicable laws or regulations.
• Your content does not infringe copyrights, trademarks, privacy, or other rights of third parties.
• Your content does not contain illegal, hateful, abusive, or harmful material.

3.2 License You Grant to Us

By uploading User Content, you grant Shain a non-exclusive, worldwide, royalty-free license to:

• Process your content with AI models in order to generate outputs for you.
• Store your content temporarily or as needed to provide the service.
• Use anonymized and aggregated data to improve the App’s performance and features, where applicable.

We do not sell or publicly share your personal photos.

4. AI-Generated Content

Images and media generated by the App (“Generated Content”) are created automatically by AI systems based on your inputs. Generated Content may be imperfect, inaccurate, or fail to resemble a person or object as intended.

You are solely responsible for how you use the Generated Content. You agree not to use Generated Content for:

• Defamation, harassment, or bullying.
• Misleading or harmful deepfakes.
• Political persuasion or misinformation.
• Discrimination, hate, or illegal activities.
• Any content involving minors or non-consensual explicit material.

5. Subscriptions & Payments

Some features of Shain may require a paid subscription or one-time purchase.

• All payments are processed through the App Store or Google Play and are subject to their billing terms.
• We do not store or have access to your full payment details.
• Refunds, where applicable, must be requested through the respective app marketplace.

Subscriptions may renew automatically unless cancelled at least 24 hours before the end of the current billing period.

6. Privacy

Your use of Shain is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the App, you agree to the Privacy Policy.

7. Prohibited Use

You agree not to:

• Use the App for any illegal, harmful, or fraudulent activity.
• Upload content that infringes the rights of others.
• Use the App to create abusive, explicit, or non-consensual content involving real individuals.
• Attempt to reverse engineer, decompile, or modify the App’s code or services.
• Upload malware, viruses, or other harmful code.

We reserve the right to suspend or terminate access if we detect misuse or violation of these Terms.

8. Intellectual Property

All intellectual property rights in and to the App, including but not limited to software, design, logos, and branding, belong to Shain and its licensors.

Subject to these Terms, you are granted a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial purposes, unless otherwise expressly permitted.

9. Disclaimers

The App is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations of any kind, express or implied, including but not limited to:

• Accuracy or reliability of Generated Content.
• Availability or uninterrupted operation of the App.
• Fitness for a particular purpose.

Use of the App and Generated Content is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Shain and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the App or Generated Content.

If you are dissatisfied with the App, your sole and exclusive remedy is to discontinue using it.

11. Account Termination

We may suspend or terminate your access to the App if:

• You violate these Terms or our policies.
• Your use poses a risk to other users or to the service.
• We are required to do so by law.

You may stop using the App at any time and, where applicable, request deletion of your account.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.
